എന്താണ്  ബലാത്സംഗം What is rape?

സ്ത്രീകൾക്കെതിരെയുള്ള ഏറ്റവും ഹീനമായ കൃത്യം ബലാത്സംഗമാണ്.സ്ത്രീയുടെ സ്വകാര്യതയിലേക്കുള്ള ഹിംസാത്മകമായ കയ്യേറ്റമാണിത്.പുരുഷൻ,ബലാൽക്കാരമായി സ്ത്രീയുടെ വ്യക്തിത്വത്തിന്മേൽ അവളുടെ സമ്മതമില്ലാതെ നടത്തുന്ന ഏറ്റവും ഹീനമായ ലൈംഗിക വേഴ്ചയാണ് ബലാത്സംഗം.

ഇന്ത്യൻ ശിക്ഷാ നിയമം 375 ആം വകുപ്പ് പ്രകാരം ഒരു പുരുഷൻ പ്രത്യേകമായി വിവരിച്ചിട്ടുള്ള പരിതഃസ്ഥിതികളിലേതെങ്കിലും ,ഒരു സ്ത്രീയുമായി ലൈംഗിക വേഴ്ച നടത്തുമ്പോൾ അത് ബലാത്സംഗം ആകുന്നു.

• അവളുടെ ഇച്ഛയ്‌ക്കെതിരായി 
• അവളുടെ സമ്മതം കൂടാതെ 
• അവളുടെ സമ്മതത്തോടു കൂടെയാണെങ്കിലും ആ സമ്മതം നേടിയത് മരണഭയം ഉളവാക്കി 
• അവളെ വിവാഹം കഴിക്കാമെന്നു പറഞ്ഞു വിശ്വസിപ്പിച്ചു 
• ബുദ്ധിസ്ഥിരത ഇല്ലാത്തതുകൊണ്ടോ,ലഹരിക്കടിമപ്പെട്ടോ സംഭവത്തിന്റെ ഗൗരവം ഉൾക്കൊള്ളാതെയുള്ള സമ്മതത്തോടെ 
• 16 വയസ്സിൽ താഴെയാണെങ്കിൽ ,അവളുടെ സമ്മതം ഉള്ളതാണെങ്കിലും ഇല്ലെങ്കിലും,

   എന്നാൽ ഒരു പുരുഷൻ 15 വയസ്സിൽ താഴെയല്ലാത്തവളായ സ്വന്തം ഭാര്യയുമായി ലൈംഗികവേഴ്ച നടത്തുന്നത് ബലാത്സംഗമാകുകയില്ല.

ബലാത്സംഗക്കുറ്റം ചെയ്ത ഏതൊരാൾക്കും,7 വർഷത്തിൽ കുറയാത്തതും,10 വര്ഷം വരെ ആകാവുന്നതുമായ വെറും തടവോ,കഠിനതടവോ ശിക്ഷയായി ലഭിക്കാവുന്നതാണ്.അതിനു പുറമെ പിഴ ശിക്ഷയും ഉണ്ടായിരിക്കുന്നതാണ്.

376 ആം വകുപ്പിന്റെ രണ്ടാം ഉപവകുപ്പിൽ പറയുന്ന പ്രത്യേകതരം ബലാത്സംഗക്കേസുകൾ താഴെ പറയുന്നവയാണ്.

👆ഒരു പോലീസ് ഉദ്യോഗസ്ഥൻ സ്റ്റേഷൻ പരിസരത്തു വെച്ച് നടത്തുന്നതോ,അല്ലെങ്കിൽ മറ്റേതെങ്കിലും സ്റ്റേഷൻ ഭവനത്തിന്റെ പരിസരത്തു വെച്ചോ,തന്റെയോ കീഴുദ്യോഗസ്ഥന്റെയോ കസ്റ്റഡിയിലിരിക്കുന്ന ഒരു സ്ത്രീയുടെ മേൽ നടത്തുന്ന ലൈംഗിക വേഴ്ച.

👆ഒരു പൊതു സേവകൻ ,ആ നിലയ്ക്ക് തന്റെ അധീനതയിൽ ഉള്ളതോ തന്റെ കീഴുദ്യോഗസ്ഥന്റെ കസ്റ്റഡിയിൽ ഉള്ളതോ ആയ ഒരു സ്ത്രീയുടെ മേൽ നടത്തുന്ന ലൈംഗിക വേഴ്ച.

👆ഒരു ജയിലിന്റെയോ,റിമാൻഡ് ഹോമിന്റെയോ,നിയമപ്രകാരം ആളുകളെ കസ്റ്റഡിയിൽ വെക്കുവാനുള്ള മറ്റേതെങ്കിലും സ്ഥലത്തിന്റെയോ,സ്ത്രീകൾക്കോ കുട്ടികൾക്കോ വേണ്ടിയുള്ള ഒരു സ്ഥാപനത്തിന്റെയോ മാനേജ്‌മന്റ് സ്റ്റാഫിന്റെ ഉൾപ്പെട്ട ഒരാൾ തന്റെ ഔദ്യോഗിക പദവി മുതലെടുത്തുകൊണ്ടു അങ്ങനെയുള്ള സ്ഥാപനത്തിലെ ഏതെങ്കിലും അന്തേവാസിയുടെ മേൽ നടത്തുന്ന ലൈംഗിക വേഴ്ച.(സ്ത്രീകൾക്കോ കുട്ടികൾക്കോ വേണ്ടിയുള്ള ഭവനം എന്നത് കൊണ്ട് സ്ത്രീകളെയോ കുട്ടികളെയോ സ്വീകരിക്കുന്നതിനും സംരക്ഷിക്കുന്നതിനും സ്ഥാപിക്കപ്പെട്ടതായ സ്ഥാപനം എന്നാണ് അർത്ഥമാക്കുന്നത്.ഇതിൽ അനാഥാലയം,വിധവകൾക്കായുള്ള ഭവനം,കുട്ടികൾക്കായുള്ള ഭവനം,പരിത്യക്ത സ്ത്രീകൾക്കായുള്ള ഭവനം എന്നിവ ഉൾപ്പെടുന്നു.)

👆ഒരു ആശുപത്രിയുടെ മാനേജ്മെന്റിലോ സ്റ്റാഫിലോ ഉൾപ്പെട്ട ആൾ,തന്റെ ഔദ്യോഗിക പദവി മുതലെടുത്തുകൊണ്ടു ആ ആശുപത്രിയിൽ വെച്ച് ഒരു സ്ത്രീയുടെ മേൽ നടത്തുന്ന ലൈംഗിക വേഴ്ച.(ആശുപത്രി എന്നതിൽ ആശുപത്രിയുടെ പരിസരങ്ങളും,രോഗാന്തര ശുശ്രൂഷയോ പരിചരണമോ പുനരധിവാസമോ ആവശ്യമായ ആളുകളെ ചികില്സിക്കുകയും ചെയ്യുന്ന മറ്റേതു സ്ഥാപനങ്ങളും ആശുപത്രിയുടെ പരിധിയിൽ ഉൾപ്പെടും)

👆ഒരു സ്ത്രീ ഗർഭിണിയാണെന്ന് അറിഞ്ഞുകൊണ്ട് തന്നെ അവളുടെ മേൽ നടത്തുന്ന ലൈംഗിക വേഴ്ച.

👆12 വയസ്സിൽ താഴെയുള്ള കുട്ടിയുടെ മേൽ നടത്തുന്ന ലൈംഗിക വേഴ്ച,

👆കൂട്ടബലാത്സംഗം:ഒരു സ്ത്രീയെ ഒരു സംഘത്തിൽ ഉൾപ്പെട്ട ഒന്നോ അതിലധികമോ ആളുകൾ തങ്ങളുടെ പൊതു ഉദ്ദേശം സാധിക്കുന്നതിനായി ബലാത്സംഗം ചെയ്യുന്നതിനെയാണ് കൂട്ടബലാത്സംഗമായി കണക്കാക്കുന്നത്.സംഘത്തിലെ ഓരോ ആളും കൂട്ടബലാത്സംഗം എന്ന കുറ്റം ചെയ്തതായി കണക്കാക്കും.

  മേല്പറഞ്ഞ തരത്തിലുള്ള കുറ്റങ്ങളിൽ ഏതെങ്കിലും ചെയ്യുന്ന ആളെ പത്തുവര്ഷത്തിൽ കുറയാത്ത കഠിനതടവിനു ശിക്ഷിക്കേണ്ടതാണെന്നും തടവ് ശിക്ഷയ്ക്ക് പുറമെ പിഴ ശിക്ഷയ്ക്കും അയാൾ അര്ഹനായിരിക്കുന്നതാണെന്നും വ്യവസ്ഥ ചെയ്തിട്ടുണ്ട്.

What is rape?

Rape is the most heinous crime against a woman. It is the most violent invasion of a woman's privacy.

Under Section 375 of the Indian Penal Code, when a man has sexual intercourse with a woman in any of the circumstances specifically described, it is rape.

• Against her will
• Without her consent
• Even with her consent, obtaining that consent created fear of death
• He told her he could marry her and convinced her

With consent without regard to the seriousness of the incident due to lack of intelligence or intoxication

If under 16, with or without her consent,

   But it is not rape for a man to have sex with his wife who is not less than 15 years old.

Punishment for rape

Anyone convicted of rape is liable to imprisonment for a term not less than 7 years and up to 10 years imprisonment or a harsher imprisonment, in addition to a fine.

Specific types of rape cases specific types of rape cases

The following are the specific types of rape cases mentioned in the second sub-section of section 376.

👆 Sexual harassment of a woman in the custody of a police officer in the vicinity of the station, or in the vicinity of any other station house, by himself or his subordinate.

👆 Sexual abuse of a woman by a public servant who is, as such, in her custody or in the custody of her subordinate.

👆 Estitution of a woman or child for the purpose of establishing a home for women or children by taking advantage of her official position as a member of the management staff of a prison, remand home, or any other place of detention under the law, or of an institution for women or children. This includes an orphanage, a home for widows, a home for children, and a home for abandoned women.)

👆 A person involved in the management or staff of a hospital sexually assaults a woman in that hospital by taking advantage of his or her official position.

👆  Sexual intercourse with a woman knowing that she is pregnant.

👆 Sexual abuse of a child under 12 years of age,

👆 Gang rape: Gang rape is defined as the rape of a woman by one or more members of a group for their own general purpose.

Punishment in special types of rape cases 

  It is stipulated that a person who commits any of the above offenses shall be liable to imprisonment for a term not less than ten years which is punishable by a fine in addition to imprisonment.

The court will consider the statement of the woman in the rape case. The statement will be confidential.
